Terms & Conditions

Last updated: October 2026

Sweet treats, special occasions and a little Cornish cowboy magic.

These Terms & Conditions apply to bookings made with Cornish Cowboy Cannolis for weddings, parties, private events, corporate events and other occasions.

By confirming a booking with Cornish Cowboy Cannolis, you agree to these Terms & Conditions. Please read them carefully and keep a copy for your records.

1. Bookings

A booking is only confirmed once we have received the required 30% deposit and confirmed your booking in writing.

Submitting an enquiry or receiving a quote does not guarantee availability or secure your event date.

You are responsible for providing accurate and complete event information, including the event date, venue, timings, guest numbers and any relevant dietary or allergen requirements.

Your booking confirmation and agreed quote will set out the services we will provide.

2. Deposits and payments

A 30% deposit of the total agreed booking price is required to secure your event date. Your booking will only be confirmed once we have received the deposit and confirmed your booking in writing.

The remaining 70% balance must be paid by the payment deadline stated on your invoice or booking confirmation. Unless otherwise agreed in writing, this will generally be four weeks before the event.

Your quote or booking confirmation will clearly state the total price, deposit amount, remaining balance and relevant payment deadlines.

If payment is overdue, we will contact you to explain the outstanding amount and give you a reasonable opportunity to resolve the issue. If payment remains outstanding, we may cancel the booking where permitted by the contract and applicable law.

If you cancel your booking, the 30% deposit will not automatically be forfeited in every circumstance. Any amount retained from your deposit, or any additional cancellation charge, will be assessed in accordance with Section 10 of these Terms & Conditions. This assessment will take account of reasonable losses and costs directly resulting from the cancellation, any costs saved and any applicable consumer rights.

Where the reasonable cancellation amount is less than the deposit paid, the difference will be refunded. Where the reasonable cancellation amount exceeds the deposit, we may seek the remaining amount where justified and legally permitted.

3. Pricing and quotations

All prices will be confirmed before your booking is finalised.

Your quote may take account of:

  • The number of cannoli required.

  • Flavour choices and ingredients.

  • Event location and travel requirements.

  • The service style and duration.

  • Setup, display and staffing requirements.

  • Any additional requests or extras.

Quotes will explain what is included and identify any known additional charges.

If you request changes after accepting a quote, we will discuss any effect on the price with you before proceeding. We will not increase an agreed price simply at our discretion.

Where a requested change cannot be accommodated within the original price or arrangements, we will discuss the available options with you.

4. Guest numbers and quantities

You are responsible for choosing an appropriate quantity of cannoli for your event.

We are happy to offer guidance on recommended quantities based on your guest numbers and service arrangements. However, recommendations are estimates and cannot guarantee that every guest will receive a particular quantity.

Please request changes as early as possible. Increases requested close to the event date will depend on ingredient availability, preparation time and our capacity.

Any agreed changes to quantities or prices will be confirmed in writing.

5. Flavours and product appearance

Flavour choices will be agreed before your event and are subject to ingredient availability.

If an ingredient or flavour becomes unexpectedly unavailable, we will contact you and discuss a suitable alternative wherever reasonably possible.

Our cannoli are prepared by hand. Minor variations in appearance, colour, decoration or finish may therefore occur.

We will make reasonable efforts to ensure the products supplied correspond with the agreed description and any confirmed specifications.

6. Allergens and dietary requirements

Our cannoli may contain or come into contact with common allergens, including:

  • Milk.

  • Gluten.

  • Eggs.

  • Nuts.

  • Peanuts.

  • Soya.

Other allergens may be present depending on the ingredients and flavours selected.

You must inform us of any known allergies, intolerances or dietary requirements as early as possible and before confirming your final product choices.

We will provide available allergen information for the products selected and take reasonable care when preparing and handling our products.

However, where our preparation environment or ingredients create a risk of cross-contact, we cannot guarantee that products are completely free from traces of allergens. We will communicate relevant information so that you can make an informed decision.

Guests with severe allergies should carefully consider the information provided before consuming our products.

Nothing in this section excludes any food safety obligations or legal responsibilities that apply to our business.

7. Event setup and access

Where your booking includes an on-site cannoli bar, display, setup or service, you must ensure we have reasonable and safe access to the venue.

This includes suitable access for unloading, setup, service and collection where required.

Please inform us in advance of any restrictions that may affect our service, including:

  • Limited vehicle access.

  • Stairs or difficult access.

  • Restricted unloading or parking.

  • Limited setup or collection times.

  • Venue restrictions.

  • Outdoor locations or unusual site conditions.

If undisclosed access restrictions result in additional work or costs, we will discuss any reasonable additional charges with you before incurring them wherever practicable.

If a significant access or safety issue cannot reasonably be resolved, we will discuss alternative arrangements with you.

8. Venue requirements

You are responsible for checking that your venue permits external food suppliers and that any necessary permissions, venue fees or arrangements are in place, unless we have agreed otherwise in writing.

Please communicate relevant venue rules, insurance requirements, food service restrictions and setup instructions to us in advance.

We will make reasonable efforts to comply with requirements that have been communicated and agreed before the event.

9. Outdoor events and weather

For outdoor events, you must provide a suitable, safe and appropriately covered operating area where required.

Weather conditions may affect the safe setup, display, storage or service of our products.

If weather conditions create a safety, hygiene or food-quality concern, we may need to adapt the setup, modify the service or suspend an affected element.

Where reasonably possible, we will discuss practical alternatives with you before making changes.

Any significant change to the agreed service or any refund due will be handled in accordance with the booking agreement and applicable law.

10. Cancellations by you

If you need to cancel your booking, please contact us in writing as soon as possible.

We understand that circumstances can change. However, cancellations may cause us to incur costs or lose work that we could otherwise have undertaken.

Where you cancel a confirmed booking, we may retain a reasonable amount from payments received or request a reasonable cancellation payment to cover losses directly resulting from the cancellation, where permitted by law.

In assessing any cancellation charge, we will take account of:

  • The notice given before the event.

  • Ingredients, personalised items and other costs already incurred specifically for your booking.

  • Costs that can be recovered, avoided or saved because the event is cancelled.

  • Any reasonable opportunity to reuse ingredients, resell products or secure replacement work.

  • The reasonable loss of profit directly resulting from the cancellation, where applicable.

  • Any other relevant circumstances.

The following notice periods provide a guide to how we will assess cancellations.

More than six weeks before the event

We will assess any refund after taking account of reasonable, evidenced losses and costs directly caused by the cancellation.

Between four and six weeks before the event

We will assess the reasonable losses resulting from the cancellation. These may include committed costs and a proportion of the booking price where justified by the circumstances.

Less than four weeks before the event

We will assess the reasonable losses resulting from the cancellation, which may be higher because of the short notice and preparation already undertaken.

These notice periods do not automatically entitle us to retain a fixed percentage or the full booking price. Any amount retained or charged must be fair and proportionate to the loss reasonably attributable to the cancellation.

We will not charge twice for the same loss or retain payments in excess of what we are reasonably entitled to recover.

Where we retain any part of a payment, we will explain the basis of the deduction upon request.

Nothing in this section affects any cancellation or refund rights you may have under applicable law.

11. Changes to your booking

We will always try to accommodate reasonable changes to your event where possible.

Changes to the date, venue, guest numbers, flavours, service duration or other requirements may affect the price or availability.

We will discuss any revised arrangements and associated costs with you before making the change. Significant changes will be confirmed in writing.

A change of date is subject to availability. If we cannot accommodate your requested date, we will discuss the available options with you. If the booking cannot proceed, the cancellation provisions in Section 10 will apply, subject to any applicable legal rights.

12. Cancellation or changes by us

In the unlikely event that we need to cancel or significantly change your booking due to illness, an emergency, unsafe conditions or circumstances outside our reasonable control, we will notify you as soon as reasonably possible.

We will make reasonable efforts to find a suitable alternative arrangement where possible.

If we cannot provide the agreed service and no suitable alternative is agreed, we will refund payments made for services that we are unable to provide.

Any other remedies available to you under applicable law remain unaffected.

We will not exclude or restrict liability where doing so would be unlawful.

13. Unforeseen circumstances

Circumstances outside our reasonable control may affect our ability to provide some or all of our services. These may include severe weather, road closures, accidents, venue closures, natural disasters, government restrictions, major transport disruption or other unexpected events.

If such circumstances arise, we will contact you as soon as reasonably possible and discuss practical alternatives where available.

Any changes, cancellations, refunds or other remedies will depend on the circumstances, the agreed booking arrangements and applicable law.

This section does not automatically remove your right to a refund or other remedy where one is legally due.

14. Service times and extensions

Where your package includes on-site service for a specified period, the start and finish times will be agreed before the event.

We understand that events do not always run to schedule, and we will try our best to be flexible where possible.

However, extensions are subject to staff availability, venue access, food safety and other commitments.

Additional service time may incur an extra charge. We will agree any additional charge with you before extending the service wherever practicable.

If an extension is not possible, we will explain the position and provide the agreed service within the available period.

15. Leftover cannoli and storage

Where appropriate, leftover cannoli may be left with you at the end of the event.

Once products have been handed over or left at the venue in accordance with the agreed arrangements, you are responsible for their subsequent storage and handling.

Cannoli are fresh products and must be stored and consumed in accordance with the food safety and storage guidance we provide.

Please do not consume products that have been stored improperly or beyond any stated safe consumption period.

Nothing in this section excludes responsibility for a product that was unsafe or otherwise supplied in breach of applicable law.

16. Photographs and social media

We may occasionally wish to photograph our cannoli displays, equipment or setup for our website, portfolio and social media.

We will respect your stated preferences regarding the promotional use of photographs of your event setup.

If you do not want photographs of your setup used for promotional purposes, please let us know before your event.

We will seek appropriate permission before using photographs that identify guests or other individuals, and will respect any applicable privacy and data protection requirements.

Your decision about promotional photography will not affect the service you receive.

17. Equipment and damage

Reusable display items, stands, serving equipment and other property supplied by us remain the property of Cornish Cowboy Cannolis unless otherwise agreed in writing.

You must take reasonable care of our equipment while it is in your or your event's control.

If equipment is lost, damaged or not returned as agreed, we may seek reasonable compensation for the loss or repair, taking account of the circumstances and any responsibility on our part.

We will explain any proposed charge and its basis. Charges will not be imposed as an automatic penalty.

18. Complaints

We want you to be happy with our service and welcome the opportunity to resolve any concerns.

If you have a complaint, please contact us as soon as reasonably possible, explaining the issue and providing any relevant details or photographs.

Where possible, please raise concerns about food quality or service on the event day so that we have an opportunity to investigate and resolve them promptly.

If this is not practical, contact us as soon as reasonably possible afterwards.

We will consider complaints fairly and respond within a reasonable time.

Making a complaint does not affect your statutory rights.

19. Liability

We will provide our services with reasonable care and skill and comply with the legal obligations applicable to our business.

We are not responsible for problems caused by inaccurate or incomplete information supplied by you, undisclosed venue restrictions, or circumstances outside our reasonable control, to the extent permitted by law.

We will not exclude or restrict liability where the law does not permit us to do so. Nothing in these Terms & Conditions limits your statutory rights or any remedy that cannot lawfully be excluded.

Where responsibility is shared, any liability will be assessed in accordance with the applicable law and the circumstances of the matter.

20. Your statutory rights

Nothing in these Terms & Conditions affects your statutory rights as a consumer.

If any provision of these Terms & Conditions is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Any term that cannot lawfully be enforced against you will not affect the rights and remedies available to you under applicable legislation.

21. Governing law

These Terms & Conditions are governed by the laws of England and Wales.

The courts of England and Wales will have jurisdiction over disputes, subject to any applicable consumer rights regarding where proceedings may be brought.
